Terms & Conditions
Terms and Conditions
Welcome to Cyrus Landscape Services Ltd!
By accepting a quotation, signing a contract, approving a project, paying a deposit, or otherwise confirming a project with Cyrus Landscape Services Ltd., the client agrees to the applicable terms and conditions set out in the quotation, contract, and these Terms & Conditions.
The specific quotation or contract will identify the agreed scope of work, materials, pricing, payment schedule, and project-specific requirements.
Scope of Work
Our quotations are based on the site conditions reasonably observable during the initial assessment and the information available to us at the time of quoting.
If unforeseen conditions or circumstances arise that require work beyond the original scope, including additional labour, materials, equipment, excavation, preparation, or disposal, we will inform you promptly and, where reasonably practicable, provide an updated cost estimate or change order for your approval before proceeding with the additional work.
Work or services not specifically included in the quotation are not included in the quoted price.
Permits and Approvals
The client is responsible for obtaining any permits, approvals, or authorizations required for the proposed work, including municipal, strata, homeowner association, or other property-related approvals.
The client is responsible for providing accurate information regarding property boundaries, easements, rights-of-way, restrictive covenants, strata requirements, and other property restrictions that may affect the proposed work.
Any additional costs or delays resulting from permits, approvals, property restrictions, or requirements outside the original scope may be charged.
Protection of Existing Property
We will take reasonable care to minimize damage to existing landscaping, structures, surfaces, and property.
Landscaping and construction work may require excavation, equipment access, material delivery, and movement through existing areas. Some disturbance to existing turf, soil, plants, irrigation, paving, or other surfaces may be unavoidable.
Restoration or replacement beyond the scope specifically included in the quotation may be charged separately.
Hand Digging and Excavation
If hand digging or excavation uncovers large roots, rocks, buried debris, or other unforeseen conditions, additional costs may apply due to the extra time, labour, equipment, or disposal required to remove them.
We will inform you of any changes to the scope and, where reasonably practicable, provide an updated cost estimate for your approval before proceeding with the additional work.
Underground Utilities and Services
The client must disclose any known underground utilities, irrigation systems, drainage systems, electrical wiring, lighting, septic systems, or other concealed services located in or near the work area.
We will take reasonable precautions during excavation and construction. However, additional work or costs resulting from undisclosed, inaccurately identified, or concealed services may be charged separately, subject to applicable law.
Where utility locating or specialized locating services are required and are not included in the quotation, the responsibility and cost will be identified separately.
Site Access and Client Responsibilities
The client is responsible for ensuring that the site is reasonably accessible and prepared for the scheduled work.
This includes removing personal items, vehicles, furniture, decorations, obstructions, or other items that may interfere with the project.
Additional site preparation or removal of obstructions outside the original scope may result in additional charges.
Reasonable access to water and electricity must be provided where required for the contracted work.
The client is also responsible for informing Cyrus Landscape Services Ltd. of any known site hazards, restrictions, or conditions that may affect the work.
Turf and Plant Damage
While we take care to minimize disruption, some turf or plant damage may be unavoidable.
Damaged turf will be repaired through seeding. If sod replacement is required, it will be treated as an additional cost and billed to the client.
Clients are responsible for watering and maintaining repaired areas to ensure proper growth and recovery.
Any damaged plants will be replaced with a reasonable and available size that closely matches the original plant.
Weather, Project Schedule and Delays
Weather and site conditions may affect the project schedule. Rain, snow, freezing temperatures, extreme heat, high winds, saturated soil, or other conditions may make certain work unsafe or unsuitable and may require the work to be postponed or rescheduled.
The project schedule may also be affected by material availability, supplier delays, permits, inspections, site access, client-requested changes, unforeseen site conditions, other contractors, or circumstances beyond our reasonable control.
We will make reasonable efforts to notify the client of significant delays and provide a revised schedule when reasonably possible.
Weather or other project-related delays may affect the anticipated completion date and do not automatically constitute a breach of contract.
Waste and Cleanup Services
General site cleanup is included for debris resulting directly from our contracted work, unless otherwise stated in the quotation.
Additional debris removal or disposal unrelated to our contracted work will be charged separately if requested by the client. Certain materials may require specialized disposal and are not included in standard waste removal services. These may include, but are not limited to, drywall, paint, oils, hazardous materials, certain electrical components, and other regulated or restricted materials.
Disposal costs may vary depending on the type, quantity, weight, and disposal requirements of the materials.
Payment Terms
The client agrees to pay the amounts specified in the quotation or contract according to the stated payment schedule.
Applicable GST will be charged where required.
If an invoice becomes overdue, Cyrus Landscape Services Ltd. may, subject to the contract and applicable law, suspend or delay further work until the account is brought current.
Cancellation and Rescheduling
If you need to cancel your project after accepting a quotation, Cyrus Landscape Services Ltd. requires at least 5 business days' notice before the work is scheduled to begin. Failure to provide this notice will result in the retention of the non-refundable deposit by the company.
If the client requests rescheduling, a new date may be offered based on our availability.
Changes, Additions and Additional Work
Any work not specifically included in the quotation, including client-requested changes, additions, modifications, or unforeseen site conditions such as buried debris, large roots, rocks, drainage issues, underground utilities, or additional excavation, will be considered additional work and may be subject to additional charges for labour, materials, equipment, delivery, disposal, and related services.
If additional work is required, the client will be advised and, where reasonably practicable, provided with an updated cost estimate or change order for approval before proceeding.
If approval is not received within the agreed timeframe, Cyrus Landscape Services Ltd. will continue with the original quoted scope and will not proceed with the additional work.
Changes or additional work should be confirmed in writing before proceeding.
Urgent or Necessary Additional Work
If immediate action is reasonably necessary to protect the property, workers, or public safety, Cyrus Landscape Services Ltd. may proceed without prior approval. The client will be responsible for the reasonable and necessary costs of the additional work, materials, labour, equipment, delivery, or disposal, to the extent permitted by applicable law.
Natural Settlement and Material Characteristics
Certain landscape and construction materials may naturally change, settle, or move over time. Paving stones, slabs, retaining wall products, natural stone, soil, mulch, and other materials may be affected by weather, drainage, soil conditions, ground movement, freeze-thaw conditions, loading, normal use, and surrounding site conditions.
Minor settlement, joint-sand movement, efflorescence, colour variation, cracking, expansion, contraction, and other characteristics that are natural or inherent to the selected materials do not necessarily indicate defective workmanship.
Where a concern is reported, Cyrus Landscape Services Ltd. may inspect the affected area to determine the apparent cause and whether the issue is related to our workmanship or to other site or material conditions.
Warranty
Any applicable workmanship warranty will be stated in the quotation or contract provided to the client before work begins.
The quotation or contract will specify the warranty period, covered work, and applicable conditions or exclusions.
Warranty coverage applies only to warranties expressly stated in writing in the quotation or contract.
Project Communication
All communication regarding the project should be done via E-mail only to ensure proper documentation and avoid any missed details.
You're always welcome to Call or Text if you have a quick question, but for any important updates, approvals, or decisions, we kindly ask that you follow up with a written email so everything is clearly documented and on record.
Photography
By hiring Cyrus Landscape Services Ltd., you grant permission for photos to be taken during and after the project for use on our website, social media, and promotional materials.
Clients who do not wish photographs of their project to be used for promotional purposes may notify us in writing.
All images will be handled professionally and respectfully.
Subcontractors
Cyrus Landscape Services Ltd. may engage qualified subcontractors, tradespeople, suppliers, or other service providers where reasonably required to complete the project.
Subcontractors may perform specialized portions of the work while remaining subject to the applicable project requirements and standards.
